1. Acceptance of Terms
By accessing or using TipMeNow ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the service. We reserve the right to update these Terms at any time.
2. Eligibility
You must be at least 18 years old or the legal age in your jurisdiction to use this Platform. By registering, you represent and warrant that you meet these requirements and have the legal capacity to enter into a binding agreement.
3. User Accounts & Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You must provide accurate, current, and complete information during registration.
- You are responsible for all activities that occur under your account.
- We reserve the right to suspend or terminate accounts suspected of fraudulent activity, including fake tipping, money laundering, or identity theft.
4. Tipping & Payments
- Voluntary Nature: Tips are voluntary gratuities and are not mandatory payments for services.
- Processing: All payments are processed via PayFast. TipMeNow acts as a facilitator and does not hold funds longer than necessary for processing and withdrawals.
- Fees: We charge a transparent platform fee (displayed at checkout) to maintain operations. You will never be charged hidden fees.
- Refunds: Due to the nature of instant peer-to-peer payments, tips are generally non-refundable once processed. In case of technical errors, please contact support within 48 hours.
5. Business & Staff Accounts
- Ownership: Businesses are responsible for ensuring all staff members added to their account consent to data sharing.
- Payouts: Businesses are responsible for paying their staff according to internal agreements. TipMeNow facilitates the transfer but is not an employer.
- Disputes: TipMeNow is not liable for disputes between businesses and their staff regarding tip distribution.
6. Intellectual Property
All content on the Platform (logos, text, graphics, software) is owned by TipMeNow and protected by South African and international intellectual property laws. You may not reproduce or redistribute content without permission.
7. Limitation of Liability
TipMeNow provides the service "as is". We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages resulting from your use of the Platform.
8. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the South African courts.
